Filipina manager jailed 6 months for stealing $79k from restaurant

Posted on 13 January 2024 No comments

Jeans (left) accompanied by a male friend, leave Eastern court after an earlier hearing

A Filipina restaurant manager was sentenced to six months in prison yesterday, Friday, after being found guilty of stealing a total of $79,420.60, the earnings of Le Colonial, a Vietnamese restaurant she used to work for.

Ofelia Isabel F. Jeans, 35 years old, looked shaken when she heard the verdict and sentence meted on her by Magistrate Vivian Ho. She tried to ask for permission to call her family after her sentencing, but the magistrate firmly said, “No” and told Jeans to course her requests through her lawyer.

Jeans could be heard sobbing loudly after she was led away from the courtroom to begin her sentence. She was earlier allowed to post a $2,000 bail while her case was being heard.

DITO ANG DETALYE

The restaurant owner who gave testimony and was in court for the verdict, said afterwards that he felt sad about what happened, especially as Jeans has a 16-year-old daughter she is raising alone.

“I do not feel happy about this,” he said. “But we gave her enough chance to settle this matter between us, and she ignored us.”

Initially, Magistrate Ho asked if she should ask a probation officer to look after Jeans’ daughter who was said to have been left alone at home, but when she did not get a positive response from the defendant, dropped the idea.

TAWAG NA!

She was also left unmoved by the defense request for a community service or fine as sentence, saying the offence committed by Jeans involved a serious breach of trust, especially as the owner had trusted her to the extent that she was left to handle the restaurant’s cash earnings on a day-to-day basis.

The defense had tried to argue that a custodial sentence would tarnish Jeans’ 14-year record in the F&B industry, and leave her daughter unable to fend for herself.

The magistrate used seven months’ imprisonment as a starting point in sentencing, and gave only a month’s discount for the $42,450 that was returned to the restaurant, made up of $30,000 that the defendant voluntarily returned, and the $10,450 owed her as her last salary after being fired.

PINDUTIN

The prosecutor had sought to get a compensation order for $38,970 from Jeans to cover the balance of the amount that she stole, but Ho declined the request after being told that the defendant would have no means to repay that because she was going to jail.

The court heard earlier that Jeans had taken up a job as an assistant manager in a Tsim Sha Tsui restaurant for which she was paid $24,000 a month.

Jeans was initially charged with stealing a total of $83,976.60 cash from Le Colonial restaurant on Paterson St. in Causeway Bay from Mar. 14 to Sept 13, 2022, when she was fired by the owner for poor performance. An updated accounting showed the actual loss to be slightly lower, at around $79,400.

When the company accountant saw the amount of money that was missing the next day, he told the owner not to give Jeans her final pay. The owner then sent messages to the defendant via WhatsApp, offering to meet with her so they could settle the case between them. However, the defendant largely ignored the messages initially, saying she was ill, or no one would be left with her daughter at home, and other excuses.

On Sept. 15, 2022, the owner told Jeans that if she would not settle, he would have no choice but to go to the police. Jeans then agreed to meet up with the owner and the company accountant, and brought with her $30,000, saying it was all the money from the restaurant that she had taken home and intended to hand over.

But she did sign a document agreeing to return the balance of the money that she took from the restaurant. Afterwards, she sent several text messages to the owner, thanking him for keeping the matter private.

Despite this, she did not comply with her undertaking, so the owner was forced to report the matter to the police.

In court, Jeans had tried to challenge the validity of the document she signed in which she promised to return the balance of the missing amount, saying she was forced to sign it because of the owner’s threat to call in the police.

She also insisted she did not steal anything and that the $30,000 that she returned was all that was left with her as part of her task of keeping a certain amount each day in the restaurant for emergency purchases.

In dismissing these claims, the magistrate said she did not accept that Jeans was threatened in any way into signing the document, or that she did not understand its contents. She said the owner had merely stated a fact when he said the police would be called if the defendant did not agree to settle the matter privately.

The magistrate also found Jeans to be a dishonest and unreliable witness, while the owner and the accountant who both gave evidence, were truthful and reliable.

Filipina DH charged with laundering $577k cash

Posted on No comments

The accused was charged with the offence at Eastern Court

A Filipina domestic helper appeared in court for the first time Thursday, charged with handling cash obtained illegally totaling $577,923, over 18 days more than four years ago.

It would appear that it took that long for Nerivy B. Toledo, 35 years old, to be charged in court because she just surrendered to authorities.

DITO ANG DETALYE

The prosecution told the magistrate at Eastern Court that it was ready for plea but counsel for Tolentino asked for the case to be adjourned until Feb 29 to secure additional documents and to seek further legal advice.

The prosecution relented, but asked for additional bail conditions for Toledo.

TAWAG NA!
After being told that the accused was on bail for $500 the magistrate said this was not enough, and raised it to $2,500.

In addition, she told Toledo to surrender her Philippine passport by 4pm, report to the Tseung Kwan O police station every Friday, between 6 and 9pm, not leave Hong Kong, and reside in the address she gave to court.

PINDUTIN

She was also told to go to the Duty Lawyer Service after putting up her bail, so she could get legal advice.

According to the charge sheet, Toledo dealt with a total sum of $577,933 between July 11 to 29, 2019, knowing or having reasonable ground to believe that the money, in whole or in part, was proceeds of a crime.

Unlike similar cases brought to court in recent months where the alleged illicit money was transferred through the ATM cards of the defendants, no mention was made in this case of a bank account being used, suggesting that cash was involved.

Wide shot of Chater Road where the assault allegedly happened

A Filipino bar tender charged with assaulting a fellow Filipino on Chater Road today pleaded not guilty to the offence when he appeared before Magistrate Ivy Chui in Eastern Court.

Mark Anthony Malunao, 35, entered his plea after being read the particulars of the charge of assault occasioning bodily harm filed against him.

He is accused of assaulting Edgardo A. Sumang at the bus stop along Chater Road on July 9 last year,  a Sunday, so the street was  closed to vehicular traffic.

PRESS FOR DETAILS

Magistrate Ivy Chui set down the trial date for Feb. 7, and extended Malunao’s bail of $500 until then.

The prosecutor said it will present four witnesses, while the defense will have two, including the accused.

TAWAG NA!

Chui told Malunao to go directly to the Duty Lawyer Service after renewing his bail so he could secure the services of counsel during his trial.

Previously, the defendant showed up in court without legal representation at least twice, prompting the magistrate to warn him that if he appeared again without a lawyer the next time he would have to defend himself as the case had dragged on for too long.

PINDUTIN

In a separate court, a domestic worker was formally charged with assaulting two fellow Filipinas, including a friend, outside a building on one of Central’s alleys on Nov 5 last year.

No plea was taken from Julie G. Balacuit, 47, and she was allowed to post a $500 bail until her next court appearance on Mar 7.

She was accused of assaulting Rodelia Dangayo and an unknown female outside no 21 Li Yuen Street in Central.

The prosecutor asked for an 8-week adjournment to secure the medical report of the alleged victim, and for the accused to seek legal advice.

The magistrate told Balaquit that while on bail she should not approach or speak with the prosecution witnesses.

Gov’t allays fear over pork safety, supply in wake of swine flu report

Posted on No comments

The government today told the public not to be concerned over a report that a pig farm in Yuen Long had tested positive for the African Swine Fever (ASF) virus, nor should they worry about the supply of pork after the farm’s 1,400 pigs are culled this week.

“ASF is not a zoonotic disease and will not infect humans, hence does not present any human health and food safety risk,” the Agriculture, Fisheries and Conservation Department (AFCD) said today.

PRESS FOR DETAILS

“Regardless of whether the pigs are infected with ASF, pork cooked thoroughly is safe for consumption. Members of the public do not need to be concerned,” it added.

“The present case does not affect the operation of local slaughterhouses nor the overall supply of live pigs,” AFCD added.

In a report, AFCD said the present ASF case was discovered because of a proactive emergency measure on handling dead pigs on local pig farms.

TAWAG NA!

Under this measure, which has been in effect since January 3, all farms are required to collect and submit to the AFCD nasal swab samples from pig carcasses for ASF virus testing. The carcasses can only leave the farms upon confirmation of a negative result.

AFCD staff inspected a licensed pig farm in San Tin, Yuen Long on January 9, collected 32 samples from pigs and tests found one of the samples positive for the ASF virus.

The AFCD has immediately suspended transportation of any pigs from the farm and arranged for the culling of all its pigs this week. It has also imposed a 3-kilometer monitoring zone around the farm; so far, this has not turned up any new positive samples.

PINDUTIN

“The discovery of pigs infected with ASF on the farm demonstrates that the measure can proactively curb the spread of the virus and effectively stop pigs infected with the ASF virus from leaving the farm, thereby interrupting the transmission of the virus among local pig farms,” it said.

An AFCD spokesman also said positive cases should be promptly handled, as ASF is very lethal to pigs.

“If the spread is not contained, a large number of pigs will die and hence seriously impacting pig farmers and the pig rearing industry,” the spokesman said.
