Christmas comes early for members of Help Circle

Dozens of Filipino and Indonesian domestic workers belonging to a support network for migrants received an early Christmas treat from Help for Domestic Workers, (HELP), at at a gift-giving and awarding ceremony held on the 59th floor of Cheung Kong Center in Central on Dec. 3.

The recipients, who all belong to Help Circle, were each given a gift sponsored by HELP’s various corporate partners, and were feted with food and awards.

Programs officer Veronica Jose said that through the network, HELP, a non-government organization that extends help to distressed migrants, “aims to create an empowered group that serves as a safety net for its members.”

Jose added that HELP strives to ensure that all migrant domestic workers have access to justice, fair treatment, and secure rights.

Following the event, Kate Husson, HELP’s head of programs told Help Circle members in a chat: "We firmly believe that each of you is equal and valuable," adding that there should be no seniority or superiority among them as they are all community leaders.

As members of the elite circle, migrant workers are asked to join community activities and attend seminars and workshops to gain knowledge and experience about leadership.

At the Christmas get-together, gold, silver and bronze awards were handed out to the members according to the number of group activities they were able to attend, while new members were given membership certificates.

Apart from the getting their fill during the three-hour program that celebrated unity and learning, some of the attendees were awarded prizes in such categories as best in decorating a “Christmas Giving Tree”, best in Christmas Carols and best in costume.

Husson told the members in the chat that the awards were not meant to discriminate, but to show appreciation for the members’ kindness and dedication in helping each other.

“It is also not about the gifts but about the recognition. Let us continue to support and uplift each other, focusing on collaboration rather than negativity,” she said. 

Member Carmela Dizon, who won the award for best costume, said she was so excited to join the party that she spent several days adorning her winning gown with Christmas lights and other decors.

She said she was grateful and glad to have joined Help Circle, which she first learned about after joining one of the free yoga sessions they offered.

Migrants braved the cold to demand inclusion and greater rights  

Members of the Asian Migrant Coordinating Body reiterated their commitment to fight “modern-day slavery, exclusion and discrimination” when they gathered in Victoria Park on Dec 17 to mark International Migrants Day.

Hundreds of people joined AMCB and its allied organization, International Migrants Alliance in expressing anger at allegations of “job hopping” among migrants and government policies they perceive as anti-migrants such as the long-standing two-week rule. Under this policy, migrant domestic workers are given only 14 days to remain in Hong Kong when their contracts are prematurely terminated.

The rallyists also alleged “abandonment” by the governments in Hong Kong and their own country in terms of giving them adequate protection and equal benefits under the law.

Despite their immense contribution to the economies of both countries, migrant workers continue to be oppressed and discriminated against, said the protesters. They cited their low wages, long working hours, unsafe working conditions and inadequate food and accommodation as bases for this allegation.

Worse, they are now falsely accused of “job hopping” when all they want is the right to switch employers when they can  no longer bear the oppressive conditions in their workplace, they added.

“Migrant domestic workers in Hong Kong are part of society, and we sustain the families and the economy of HK; we must be treated like any other worker in HK,” said the group.

They vowed to continue fighting for their rights until the governments of the host and sending countries listen to their pleas and address their demand to end “modern-day slavery and commodification or migrant workers.”

Further, they called on their governments to end their labor export program and instead create more jobs that pay a living wage back home so they are not forced to work abroad to support their families.

3 Filipinos get differing endings for theft cases

Three Filipinos separately charged with theft, ended up with differing fates after they appeared before the same magistrate at West Kowloon court today – Edelyn Acero was returned to jail despite offering a higher bail, E. Blancio got off with a bind-over or a promise not to commit any offense for one year, and J. Cardema got a community service order.

Acero, 34 and an asylum seeker, leaned on a gap in the glass enclosure for detained defendants, to listen to a Filipina interpreter and nodded after she heard Magistrate Jason Wan’s rejection of her offer to raise her bail from $2,000 to $2,500.

Magistrate Wan said he based his decision on the nature and seriousness of the charges she was facing, the likelihood of conviction, that the evidence was strong and that she was on bail for another case when she committed the offenses.

Acero is accused of stealing $2,000 in cash from a laundry shop on Fak Wing St., Sham Shui Po, last Nov. 9.

The same night, it was alleged, she damaged the lock of a room in another building in Sham Shui Po.

The following day, while under investigation at the Sham Shui Po police station at Yen Chau St., she damaged a wall and a frame for the intercom.

Blancio, 57 years old, was charged with stealing one bottle of shampoo, one tube of toothpaste, one pack of glutinous rice, one can of coffee, one pack of strawberry yoghurt, one box of mint chocolate, and one box of milk chocolate.

The theft happened on Nov. 7 at a Wellcome Supermarket in Tsuen Wan, where an employee said he saw Blancio on CCTV placing the items into the cart, and blocked her as she was leaving the store without paying.

Wan told Blancio that both the prosecution and defense agreed to recommend the bind over, which is not a conviction and will not give her a criminal record. He placed a $1,000 penalty if she reoffends within one year, and charged her $500 for court costs.

Cardema, 19 years old, was charged with stealing $1,000 in cash and one pair of shoes worth $2,000 from a local man in an office in Pakpolee Center in Mong Kok last Sept. 17.

The prosecutor recommended that he render community service order for 80 hours, which Wan approved.

But he also warned Cardema that if he does not work diligenty and cooperate with the probation officer who will supervise him, “I will sentence you to prison.”

Filipina asylum seeker lied about being threatened by disabled official, High Court says

Asylum seeker alleged ex-Governor Grace Padaca stabbed and threatened her

A Filipina overstayer who was found to have lied extensively about an alleged attempt on her life by former Isabela governor Grace Padaca failed in her bid to challenge a decision by the Immigration Director and the Torture Claims Appeal Board denying her refuge in Hong Kong.

In a decision handed down on Dec. 18, the High Court, through Registrar Allen Lee, denied an application for leave for judicial review by Donna Mae G. Abesamis, who is seeking non-refoulement or against being sent back home, after overstaying her visa for three months in 2018.

The court noted several glaring errors in the grounds cited by Abesamis, now 31 years old, in seeking to set aside Immigration’s decision to send her back to the Philippines, most notably her claim that ex-Governor Padaca, who is disabled and walks with crutches, had stabbed her over a dispute.

Abesamis, who hails from Burgos, Isabela, first came to Hong Kong to work as a domestic helper in February 2016, and last entered on Mar 4, 2018. Her employment contract was terminated on July 31, 2018 and instead of leaving Hong Kong 14 days after this date, decided to to overstay. She surrendered to authorities on Oct. 19, 2018 and two months later, filed an application for non-refoulement.

To support her application, Abesamis claimed that if she were sent back home, Padaca would harm her because the former Isabela governor was blaming her for losing the 2015 gubernatorial elections.

Padaca also allegedly wanted her to return the P160,000 she was paid to act as a poll watcher in the election and to buy the votes of her family. Abesamis said she had already used the money to pay off a loan.

A month after Padaca supposedly lost the election in June 2015, the politician allegedly went to Abesamis’ house in Burgos with three goons and threatened to kill her if she didn’t give back the money.

Padaca allegedly went with her men again to Abesamis’ house in November 2015 and in the ensuing confrontation, one of the men stabbed the applicant, causing a two-inch wound on her right thigh. (Earlier, Abesamis said it was Padaca herself who did the stabbing). Padaca again threatened to kill her unless she returned the money.

As a result of these incidents, Abesamis said she decided to work in Hong Kong. However, this did not deter Padaca from repeatedly visiting her parents’ house to ask about her whereabouts.

Abesamis further claimed that every time she went home for a holiday, she never went home to her hometown for fear of running into Padaca and her men. She said that because of Padaca’s influence, it was unlikely that she would be given protection by Philippine authorities.

Perhaps unknown to Abesamis, the TCAB checks claims by torture claimants against country of origin information, and as a result, found several inconsistencies in her claims.

First, the gubernatorial elections in the Philippines took place on May 9, 2016 and not in 2015 as she had claimed.

Second, it was not true that Padaca served as governor of Isabela from around 2010 to 2015. She was elected earlier, but was unseated in 2009 and did not run again. A simple search of newspaper articles showed that from 2012 to 2015 she served as a commissioner at the Commission on Elections.

Third, Abesamis claimed there were only two candidates for the post of governor in Isabela in 2015 or 2016, namely Padaca and a certain Bodjie. In truth, not only did Padaca not run for the post then, but there were four candidates in the election, and the man identified by Abesamis in photos as Bojie was not one who contested the 2016 vote but his son, Faustino G. Dy III.

Fourth, she claimed in a written submission in December 2018, that Padaca herself had stabbed her, but later corrected it was the politician’s bodyguard who did it. But the Board noted this as odd since it would have been impossible to make a mistake between a male assailant and Padaca who uses crutches and would have had extreme difficulty in attacking, much less stab her.

To top it all, Abesamis showed a lack of knowledge about gubernatorial elections, such as how many voting precincts there were, how many people voted in the election, and even the number of candidates and their identities.

Following these findings, the Board found that Abesamis had fabricated most, if not all of her evidence, including her allegation that authorities in the Philippines had been complicit in her alleged ill-treatment. As a result, the Board decided that the applicant had failed to establish the factual basis to support her claims for protection under the law.

Despite this, Abesamis reiterated as grounds in her judicial review the reasons she gave the Board in applying for non-refoulement. She did not cite any errors in law, but said the Board was wrong in relying on country of origin information which she claimed were simply hearsay and at times outdated.

The High Court rejected her claims, however, saying that the function of the court in judicial review is not to reassess non-refoulement claims, but to scrutinize the Board’s decision, and intervene only for “errors of law, procedural unfairness or irrationality.”

The court also dismissed other grounds cited by Abesamis, including lack of adequate legal representation, insufficient time to read documents before the Board heard her case, and her supposed inability to fully understand the English language.
