Detention continues for ex-DH who overstayed for 27 years

The detention of a Filipina arrested in Central last September for overstaying her visa for 27 years, was extended today after her duty lawyer sought another adjournment of the case to await the result of her request for asylum as a torture claimant.

Josephine Rescate, who is now 61 years old, has filed with the Immigration Department her application for non-refoulement to prevent her being sent back forcibly to the Philipines, her lawyer told Principal Magistrate Ivy Chui at a hearing at the Eastern Court.

Since she has not applied for bail, she was returned to jail to await the next hearing on Feb. 14.

Rescate is facing a charge of breach of condition of stay, in violation of the Immigration Ordinance, for overstaying her visa since Sept. 29, 1996, after she was terminated from her work as a domestic helper.

She managed to remain underground until her arrest on Sept. 7, 2023 on the footbridge near Exit A of the Central MTR station.

She has since been detained after the court rejected her application for bail.

Another former domestic helper, Teodora Quijano, 33 years old, remained free when she was allowed by Magistrate Chui yesterday (Dec. 18) to post bail of $5,000 in a separate case of overstaying for one and a half years.

Quijano was charged with breach of condition of stay after she was arrested by police in a room in Ming Court Guest House in Wan Chai, last Sept. 3.

She was supposed to leave Hong Kong until May 29, 2022, or two weeks after she was terminated as a domestic helper on May 15, 2022, but stayed on until her arrest.

The day-long Paskong Pinoy on Chater Road will be kicked off with the OFW Day celebration

A merry Christmas is in store for Filipinos in Hong Kong when they take over the entire Chater Road in Central on December 24 for a host of activities that will include a variety show, games, lantern-making contest, midnight mass and a “Paskong Salubong”.

The whole-day event called “Paskong Pinoy sa Hong Kong at PaStaran 2023” is jointly organized by the Overseas Workers Welfare Administration and the Philippine Consulate General in Hong Kong.

It will mark the first time in four years that a big public gathering of Filipinos on Christmas eve for the announcement winners in the “PaStaran” lantern-making contest and the Misa de Aguinaldo – suspended due to widespread protests and the Covid-19 pandemic - will be in held in Central.

This time around, it will be held simultaneously with OWWA’s OFW Day, which will be personally led by the government agency’s administrator, Arnell Ignacio.

According to welfare officer Marilou Sumalinog the tribute to OFWs was originally planned to be held on Dec 10, ahead of International Migrants’ Day on Dec 18, but the Hong Kong government declined permission for Chater Road to be used for a public event that day, as it coincided with District Council elections.

Thus, some major artists who were supposed to grace OWWA’s tribute to OFWs had to cancel, as Christmas eve is often reserved for family celebrations back home. As of this writing, she said she was not sure if VIPs or guest artists from the Philippines would come.

Nevertheless, the day is expected to bring cheer to many OFWs, as several community organizations are on board to present songs, dances and take part in games and contests.

The day will start with a thanksgiving mass at 9am, followed by parlor games, mass zumba dancing, and a parade. In the afternoon, outgoing Consul General Raly Tejada will lead other officers of the Consulate and the Migrant Workers Office in delivering speeches and Christmas messages to the community. OWWA Administrator Ignacio is keynote speaker.

The afternoon program will be capped with a sing and dance competition and a mass dance by some 500 OFWs.

Winners of the PaStaran contest will be announced at 7:30pm

In the evening, the Consulate will announce the winners of its month-long PaStaran contest, where Filcom organizations were invited to show their creativity by coming up with traditional lanterns or “parol” using mostly recycled materials.

The group to be adjudged Grand Winner will get $5,000; first runner-up, $3,000; second runner-up, $2,000. The winner of an online voting contest will get the People’s Choice Award and $1,000.

The Misa de Aguinaldo will be held at 10:00pm, with the Catholic Chaplain for Filipinos, Fr. Jay Flandez, officiating.

Wrapping up the whole-day celebration will be “Paskong Salubong” or what’s envisioned to be a festive welcome to Christmas Day, to be held right at midnight .

Cold days forecast over Christmas

While today was comparatively warmer than the record-low 11.4 degrees Celsius reported yesterday morning, the Observatory says there will be colder days ahead.

From Wednesday, Dec. 20 until Sunday, Dec. 24, the temperatures are forecast to range between 11 to 18 degrees, with the coldest days being Friday and Saturday, when the temperature will rise no higher than 15 degrees during the day.

As usual, it will be much colder in the New Territories.

Everyone, including migrant workers who are bracing to gather for pre-Christmas parties and other events on Sunday and Monday, which is a statutory holiday, are well-advised to wrap themselves up and to stay away from the sea where the wind is much colder.

Filipina DH wins right to present sex video in civil case vs elderly doctor

A Filipina domestic helper has scored an initial victory in the civil case she filed against an 85-year-old retired British doctor, who she claims had molested her, when a District Court judge allowed the showing of two pornographic videos as part of her evidence.

Lawyers for the defendant, Brian Drew Apthorp, had tried to block the use of the video clips which the plaintiff, identified only as C.B., claimed was shown to her by the octogenarian prior to molesting her.

The defense argued that the clips, which purportedly showed Apthorp in a sexual act with another woman, had no direct bearing on the case, but the prosecution said they can prove the defendant’s character and background.

After hearing both sides, Deputy District Judge David Chan allowed the clips to be presented in court, but said he has yet to decide on their weight as evidence..

Earlier, CB also won the right not to have her full name disclosed in public.

CB which is represented by solicitors Patricia Ho and Associates on legal aid, is claiming more than $1 million in compensation for personal injury and pain and suffering.

Among other allegations, she said the retired doctor had molested her on the pretext of conducting a physical examination, repeatedly ordered her to massage him while fully naked, and watch pornographic videos with her.

C.B. was then called to the witness stand, during which she confirmed that she had attained college education in the Philippines, and a caregiving certificate. She first worked in Kuwait and Singapore, before moving to Hong Kong in 2014.

She said her first employers were a couple who were both police officers. She admitted describing them as “bad people” as they gave her little food and often shouted at her. She said she tried to put up with them as it cost her money to get to Hong Kong, but they terminated her contract after three months and she had to return to the Philippines.

She first read about Apthorp’s need for a domestic worker from the online page, Geoexpat, after her second contract was terminated by her employer for financial reasons. After an initial interview, she said Apthorp’s helper at the time, Janice Villanueva, called her up and asked her to report for work in September 2018 at the employer’s 3,000 square foot house in Shouson Hill.

At the time, CB said she did not pay much attention to a document detailing her responsibilities as a helper, and stating that a pre-employment medical examination was required. She was asked if she knew that the defendant was a doctor and could thus do the examination himself, but she said she did not know. Besides, she knew that it was standard practice for most employers to require a medical check, but this was something done in a clinic or hospital.

In an attempt to show that she had been feigning ignorance about the job requirements that Apthorp had supposedly made clear to her from the beginning, the defense lawyer pointed out CB could not have possibly just skimmed through the document that mentioned additional benefits, including a “generous bonus” if she completed the contract.

The lawyer also asked why CB said she could no longer remember how long her initial job interview took when she said during Apthorp’s retrial only in November last year that it lasted an hour and a half.

When CB said she did not expect Apthorp to ask her to bathe him naked, the lawyer asked if she was not taught this in the caregiving course that she took, and she said they were told the person they were looking after should be in shorts.

The lawyer said then that the only reason CB was insisting that she did not pay much attention to the document she was made to sign was because she did not want the court to know that she had known all along what working for Apthorp entailed.

CB said this was not true as she had nothing to hide, and she knew it would not do her good to lie.

Earlier, she also denied undergoing a psychological examination with the Dignity Institute because she was preparing to file a civil claim against Apthorp. CB said it was because she thought she needed help because she was “not in a good mental state.”

Apthorp was convicted of three counts of indecent assault on CB in July 2021, for which he was sentenced to 30 months in jail. But a retrial ordered by the High Court led to his being acquitted of all charges in November last year.

The hearing of the civil case is expected to last for five days.

Asylum seeker fined $1k for possessing Viagra

Viagra, a brand name for sildenafil, is a prescription drug in Hong Kong

A 45-year-old Filipino recognizance paper holder (which shows his opposition to being sent back to the Philippines), was fined $1,000 at Eastern Court on Friday, after he pleaded guilty to possessing 3 tablets and fragments of another tablet of sildenafil, which is sold under the brand name Viagra.

Sildenafil is listed as Part 1 Poison in the Pharmacy and Poisons Ordinance, which prohibits anyone from having it in their possession without a prescription.

C.K.D., who lives in Yuen Long, was found to have the prohibited substance in his bag when he was stopped for a random check at the junction of Canal Road West and Hennesy Road in Wanchai on October 26  this year.
