Filipina denied entry to HK stranded at Macau border for 3 days

Filipino domestic workers who get terminated in Hong Kong and try to wait for a new working visa in Macau, beware.

A Filipina who stayed in Macau as a visitor for the maximum visa-free period of 30 days then tried to get her visa extended for another 30 days but failed, was left stranded for three days at the border after being turned away by Hong Kong immigration.  

The plight of the overseas Filipina worker named Irene was made known to fellow Filipinos in Hong Kong by a concerned friend who posted a call for help Monday on the Facebook page of the FDW group, Social Justice for Migrant Workers (SJMW).

(Helping a fellow Filipina, she is asking for help. She has been at the border with Macau, she has been refused entry, she was also refused (more so) in Hong Kong. She was waiting for her visa here in Macau, but she used up her (visitor’s visa) so she was not allowed back in).

According to SJMW’s Beth Rizardo, Irene did not have anything to eat for the three days that she was at the land border between Hong Kong and Macau because her friends who tried to send her food were not allowed in. They only managed to send drinks through a Filipina cleaner at the border station.

After hearing about her plight, the Social Justice administrators who include Beth immediately sent out an SOS to the Philippine Consulate and the Migrant Workers Office in Hong Kong, who in turn, asked help from their counterparts in Macau.

Assistant Labor Attache Tony Villafuerte who heads the MWO’s assistance to OFWs section, said in a conversation Wednesday afternoon that they had relayed the call for help to Macau Labor Attache Nena German, who helped coordinate Irene’s immediate repatriation with the Consulate there.

According to both Beth and Carina, Irene was fetched at the border by Consulate staff and escorted to Macau airport, where she was put on a Manila-bound flight at 8:20pm last night.

Irene had told her friends that after using up her 30-day visa in Macau, she exited through Portas do Cerco, the barrier gate separating Macau from mainland China. But like many other Filipinos before her, she did a quick turnaround, hoping to get another 30 days of visa-free stay. To her dismay, she was given only three days.

She had planned to leave for Thailand supposedly but the agency trying to work on her new employment visa advised her to re-enter Hong Kong. Again, as many Filipinos would attest, this had been done before, and they did manage to enter Hong Kong again, though their stay as tourists is cut to just a few days.

But in a sign that authorities on both sides of the border are now plugging this loophole, Irene was refused entry to Hong Kong. She then tried to re-enter Macau, but was also stopped, leaving her in no-man’s land for three days.

“That is why we keep telling them not to take the risk of exiting to Macau, but to go back to the Philippines and wait for their visa there,” said Villafuerte.

This is also why Philippine laws mandate that all new hires must leave from the Philippines so they go through the whole process of getting their contracts validated and their rights ensured in their host countries.

But the high cost of going through an agency, both for the employer and the worker, and the long wait, not just for the visa, but also for the processing of their documents, is what makes staying in Macau a more attractive option to many.

In the case of Irene, the wait will now be longer, as the agency in Hong Kong will have to look for a counterpart in the Philippines, which by law, are the only ones allowed to process a new employment contract for a departing Filipino worker.

If she gets lucky, her Hong Kong employer would be willing to wait, and pay for the far higher fee charged by agencies to get her to come back and work here again.

Filipina admits trafficking 1 kilo of “ice”, to be sentenced at High Court

Packed methamphetamine seized 2 days before the accused was arrested

A Filipina who pleaded guilty to trafficking almost a kilo of methamphetamine chloride or shabu, will be sentenced at the High Court after appearing at Eastern Court today, Nov. 23.

Liza D. Soriano, 44 years old, was returned to jail by Magistrate Minnie Wat. No date has been set for her next appearance.

Soriano has been detained since her arrest by Customs and Excise Department officers on Jul 28, 2022.

The charge sheet prepared for the transfer to the High Court did not mention a second charge of violating her condition of stay by staying in Hong Kong after her visa expired on Dec. 2, 2021.

Soriano was arrested in front of a building on 23-25 Third Street, Sai Ying Pun, with 995 grams of crystalline solid containing 985 grams of the drug, also known as ice.

Such offense is punishable by up to $5 million fine and up to life imprisonment under Section 4 of the Dangerous Drugs Ordinance.

Since the magistrate is only allowed to mete out punishments of up to $100,000 in fines and up to two years’ imprisonment, it had to elevate the case to the High Court.

Meanwhile, another Filipina also appeared in Eastern Court to face two charges of drug trafficking and a charge of overstaying.

However, the prosecutor told Magistrate Stephanie Tsui that they were not yet ready to proceed with the case against Emilia Tamorite, 43 years old, who was accused of trafficking in an unspecified quantity of drug after she was arrested last Sept. 7 in the eighth floor staircase of Leishun Court on Leighton Road in Happy Valley.

She was again arrested on Sept. 25 at Sing Kung Lau on Electric Road in North Point, also dealing in an unspecified amount of drugs.

During investigation at the North Point Police station, she was found to have overstayed for three years. She was allowed to stay in Hong Kong to work as a domestic helper until July 9, 2020 but has not left.

The case was adjourned until Jan. 18. Tamorite was returned to jail.

2 waiters fined for stealing coffee, ice cream from unmanned stand

Two waiters who got drunk and stole coffee and ice cream from a closed coffee stand in Cyberport, got off with a fine after they pleaded guilty to theft today at the Eastern Court.

Magistrate Stephanie Chui imposed on the two – Filipino J. de la Rosa, 22 years old, and Pakistani M. Khan, 23 – a fine of $800 each and ordered them to pay their half of $258, the cost of the two cups of coffee and five cups of ice cream that they consumed.

The incident happened at the Matcha Tokyo coffee stand on the 3rd floor of Cyberport 3 in Pokfulam, at about 7 am last July 18.

According to the charge sheet read to them, a witness called the police when he saw the two reach into the cloth shrouding the unmanned coffee stand and consume the stolen coffee and ice cream. The whole incident was captured on CCTV

Khan even left his umbrella, which was discovered by the staff who opened the coffee stand later that morning and discovered the mess they left.

The two were identified, traced and arrested. During investigation, both admitted the theft.

In mitigation, their lawyer said the offense was committed foolishly while they were drunk, and which they deeply regret.

He said both were the family breadwinners – dela Rosa for his parents who work part-time as diswashers, and Khan for his father and younger brother.

Filipina, American charged with drug trafficking

The case was heard at West Kowloon Court

A Filipina stood beside an American at West Kowloon Court yesterday, Nov. 21, to face a charge of drug trafficking.

But the prosecutor said they were not ready to take pleas from Rosita Palao, 54 years old, and Stephen Dickensheets, 66, because the Government Laboratory has not finished analyzing the 10-kilo liquid suspected to contain cocaine seized from them.

The two were arrested with the suspected drug on May 14-15 in Hong Kong, according to a complaint filed by the Customs and Excise Department.

A press release issued by the Department on May 15 said the 10 kilos of liquid cocaine estimated to be worth $8 million, was carried by Dickensheet when he arrived in Hong Kong from Sao Paulo, Brazil, via Paris, France.

During customs clearance, officers found 17 pieces of bed sheets soaked with the suspected drug inside his checked-in suitcase. He was promptly arrested.

After a follow-up investigation, Palao was arrested in Tin Shui Wai on suspicion that she was connected with the case.

Both suspects were subsequently charged with violation of the Dangerous Drugs Ordinance,

Under this law’s Section 4, drug trafficking is punishable by a fine of $500,000 and imprisonment for 3 years if summarily convicted, or a fine of $5 million and imprisonment for life if convicted on indictment.

Magistrate Jason Wan Adjourned the case to Feb. 8.

Lik Sang shopowner gets costly lesson for selling mercury-laden beauty products

A Filipina who was caught displaying $420 worth of “harmful” beauty products in her shop, got a costly lesson when a criminal complaint filed against her by the Customs and Excise Department was resolved today at the West Kowloon Courts.

M.F. Ng, 55 years old, not only had to close her 1-Stop Filipino goods shop at Lik Sang Plaza in Tsuen Wan after a raid last Nov. 3 by Customs offiers, she was also fined a total of $5,000 after she pleaded guilty today to two charges of violating the Consumer Goods Safety Ordinance.

Magistrate Jason Wan fined her $4,000 for displaying for sale seven pieces of Goree Beauty Cream with lycopene, avocado ang aloe vera, and five pieces of Goree Beauty Cream Oil Free which did not comply with the general safety requirement for consumer goods.

A chemical analysis  by the Government Laboratory showed that the products contained 20 milligrams per kilo of mercury, 20 times Hong Kong’s limit of 1 mg per kilo. Since lead poisoning can damage the nervous system, that concentrtion poses a health risk for consumers.

Wan also fined her $1,000 for the same products not having a bilingual health warning required by the law to be posted on their packaging.

Ng, a divorcee who now works as a waitress to support her son and sickly mother, was allowed to pay the fines – minus the $500 she had posted as bail – in two installments until Jan. 22. Otherwise, an arrest warrant will be issued against her, Wan said.

Wan said he issued the penalties after weighing the fact that Ng had a clear record, pleaded guilty at the earliest opportunity, maintained to police that she did not intend to violate the law, and has closed her shop so she would have less chances of reoffending. 

He also noted that the value of the offending items was low.

The prosecutor had earlier said, when asked by Wan, that the penalty for each of the charges is $10,000 fine plus one year in prison.

Wan also declined to impose the customary payment of $10,000 to the Government Laboratory for the cost of analyzing the products, saying their value is so small.

Overstayed for 27 years, now wants to ask for asylum

A Filipina former domestic helper who was arrested in September after overstaying her visa for 27 years told the court today that she is applying for asylum as a torture claimant, and asked that the hearing of her case be put off until after her application is dealt with.

Josephine Rescate who is now 61 years old, did not apply for bail when she appeared before Magistrate Stephanie Chui at Eastern Court.

Her counsel from the Duty Lawyer Service told the court that this coming Thursday, Nov. 23, Rescate will apply for non-refoulement or against being sent back home, citing risk of torture as ground.

She asked that the next hearing of her case for visa violation be postponed to Dec. 9 pending the outcome of her torture claim.

Magistrate Chui approved the application, but told Rescate that she should make sure she is again represented by counsel when she returns to court because the hearing of her case will continue even if she is unrepresented.

Previously, Rescate had applied to the court for bail but was rejected.

In her earlier court appearance, the prosecuting counsel said Rescate had been overstaying her visa since Sept. 29, 1996, after she was terminated from her work as a domestic helper.

She managed to remain underground until her arrest on Sept. 7, 2023 on the footbridge near Exit A of the Central MTR station. But no other details of her case were brought up in court.
