Only Pinoy athlete in Gay Games wins bronze in table tennis

The only Filipino to take part in Asia’s first Gay Games has won a bronze medal in the table tennis doubles match held at the Kowloon Junior School yesterday, Nov. 5.

Melvin “Benj” Torres, 38, a former member of the Philippine national team in the sport, and Hong Kong player Kelvin Lo, 34, teamed up to take the third top slot in the game.

Benj said he met two Filipino representatives from Los Angeles and Hong Kong at the opening ceremony for the Gay Games held Saturday at the Queen Elizabeth Stadium in Wanchai, but they did not take part in the competition.

He said he intends to be involved again in the next Gay Games, slated to be held in Valencia, Spain, in 2026, either as an athlete again or as a mentor to those who are interested to join.

The Gay Games was first established in 1982, and was supposed to have its Asian debut in Hong Kong last year but pandemic-related restrictions caused it to be moved to this year.

Despite the long preparation, the road to the Games that Hong Kong is co-hosting with Mexico has not been smooth, with only about 2,400 athletes taking part, instead of the roughly 15,000 that was expected.

Only 45 countries and territories are represented instead of the 100 that originally expressed interest, and only 18 events instead of the 36 first envisioned are being held.

There were also calls from critics for the competitions to be cancelled for reasons of national security, but these were mercifully disregarded.

Local athletes are particularly happy because the Games meant another big step in their fight for recognition in traditionally conservative Hong Kong, where homosexuality was decriminalized only in 1991. Same-sex marriage is still not allowed in the city.

Another big event being anticipated is the annual Pride Parade which returns to Hong Kong later this month. The event drew 12,000 people onto the streets in 2018 but the pandemic forced organizers to move the celebration indoors, or in parks.

The Gay Games will last until Saturday, Nov. 11.

Cooler days forecast for next week

Jumper days are back in HK (File)

The Observatory says cooler days are in store starting next week as a strong northeast monsoon is expected to sweep across southern China over the weekend.

The minimum temperature is forecast to fall to 20 degrees in the urban areas next Monday, Nov. 13, and a couple of degrees lower in the evening and in New Territories.

Filipino driver who seriously injured pedestrian asks for time to settle case

The lawyer for a Filipino facing a charge at Shatin Court for dangerous driving that injured a pedestrian has proposed an alternative end to the case.

The duty lawyer of Bernardo Bernardino, 63 years old, did not give details on his proposal to the prosecution, but asked for adjournment to give way to the negotiations with the prosecutor.

The prosecutor did not object to the adjournment and the continuation of terms for Bernardino’s bail of $5,000, such as not leaving Hong Kong while the case is pending, reporting regularly to police and informing the police if he moves to a new address.

Magistrate David Chum set the new hearing for Dec. 12.

Chum also advised Bernardino to stay in touch with his lawyer to update himself on the progress of negotiations.

Bernardino was accused of hitting a pedestrian, Wong Lai-kiu, while driving at Hai Tei Square in Tsuen Wan last April 6.

Police charged him with dangerous driving causing grievous bodily harm, which violates the Road Traffic Ordinance.

Section 36A of the ordinance sets two tiers of punishments for such offense: A fine at level 5 ($50,000) and imprisonment for seven years if convicted on indictment, and a fine at level 4 ($25,000) and imprisonment for two years on summary conviction.

Court allows Filipina's application not to be named in civil suit vs ex-employer

District Court judge told fellow Filipinos have been particularly harsh on plaintiff

A Filipina domestic worker who has filed a personal injuries claim against her octogenarian former employer has won the right not to have her full name disclosed in court-related proceedings and documents, as well as in any report by the public or the media on her case.

In a ruling handed down on Friday, Nov. 3, Deputy District Court Judge David Chan allowed the plaintiff to be named only as “CB” in all matters relating to the case she filed against retired doctor, Bryan Drew Apthorp.

While Judge Chan accepted that the order was a departure from the norm, he chose to exercise the right of the court to issue an anonymity order, “as the interest of the private lives so required.”

He cited the possibility of CB being targeted for further victimization by “haters” in the Filipino community and the public in general, as well as the devastating effects the disclosure of her identity could have on her two daughters who are unaware of the ongoing cases.

CB’s civil suit comes at the close of two trials of the three sexual assault charges she filed against 84-year-old Apthorp. The first resulted in his conviction, but after a retrial ordered by the High Court on appeal, he was cleared of all charges.

The civil proceedings started on Feb 5, 2021, and in the writ of summons, the parties’ names were revealed. However, during the criminal trials in Eastern Court which ended in December last year, CB was referred only as “X”.

On October 5 this year, CB filed an application with the District Court, asking that her full name be withheld from all court proceedings and documents, citing a number of reasons, including the alleged “unforgiving and cynical” comments made by the Filipino community against her during the criminal trial.

Those comments were said to have added to the mental and emotional distress that she was already suffering due to the traumas she experienced from the alleged indecent assaults.

She also claimed that the Filipino community in general is not very sympathetic to victims of  sexual assaults, and the same applies to the Catholic community which she is part of.

Disclosing her name in the instant case would just continue the victim-blaming and shaming she has suffered, that she may choose to just discontinue her claim, she added.

CB also said that while she is currently employed, putting her name out in public could be fatal to her future career prospect in Hong Kong.

Finally, she worried about the psychological effect on her daughters, aged 21 and 16 years old, if they learned from news reports that their mother was subject to the alleged indecent assaults and exploitation. She said she has not told her daughters about the case.

No affidavit was filed on behalf of Apthorp to oppose CB’s application. But in his written submissions, the defendant’s counsel said the plaintiff failed to show that there were exceptional circumstances that would warrant a deviation from the principle of open justice. Neither did she explain the delay in filing her application.

In his judgment, Judge Chan emphasized that to deviate from the public nature of court proceedings, it is essential for the applicant to show clearly the grounds that would justify the issuance of an anonymity order.

The judge then said he was not impressed by some of the arguments raised on CB’s behalf, particularly that which said disclosing her identity would be fatal to her job prospects. If this were the case, he said all employees suing their employers in the Labour Tribunal should have the claimants’ names hidden.

Judge Chan also dismissed CB’s claim that an anonymity order could ease the mental and emotional distress she suffered from negative and derogatory comments during the criminal proceedings.

“With or without her name revealed, the upcoming trial could still be reported by the media, and haters within the public/community/netizens are still going to express their hatred.. and (she) could again be emotionally distressed,” said the judge.

However, he conceded that having CB’s full identity revealed could heighten her distress as the derogatory comments will then be directed at her, and the “more conservative and/or extreme members of the public…would have a clear target for their shaming, blaming, and discriminating.”

It did not matter if the defendant was cleared of all criminal charges, added the judge, as the nature of the sexual assault allegations in the case could expose the plaintiff to further victimisation.

He also agreed that seeing their mother’s name mentioned in connection with the alleged indecent assaults could have a devastating effect on CB’s daughters.

“I see no reason why they should be put in such position,” said the judge.

Judge Chan ordered that the costs of the application be paid by the defendant to the plaintiff, with certificate for counsel, to be taxed if not agreed.  The plaintiff’s own costs should be taxed in accordance with Legal Aid Regulations.

The plaintiff was represented in court by Eric Shum and Yvonne Leung (on pro bono basis), on instructions by Patricia Ho & Associates, as assigned by Legal Aid.

Umaga pa lang noong Oct. 31 ay humahangos na paalis ng bahay si Janice Morales de Pablo dahil sa tawag na may nag-aaway sa karatig na sitio. Maghapon siyang natali siya sa pag-ayos sa gulo at pag-tulong sa pulis na nag-imbestiga.

Dahil dito, imbes na magbunyi dahil sa muling pagkahalal bilang kapitana sa barangay election na isinagawa noong nakaraang araw ay sumabak agad sa trabaho si Janice.  Pwede naman daw kasing maghintay ang selebrasyon.

Kinabukasan na siya nakapaglabas ng pasasalamat sa mga taong tumulong sa kanyang kampanya at sa mga botante ng Brgy. Batuan sa Balasan, Iloilo.

“Batuanon, kayo ang nanalo,” ika ng ang dating OFW sa Hong Kong sa kanyang Facebook page sa salitang Hiligaynon. “Dadagdagan at ipagpapatuloy ko ang aking magandang nagawa para sa ikauunlad at katagumpayan ng lahat.”

Nakapag-tapos din siya sa Ateneo Leadership and Social Entrepreneurship (LSE) program, isang proyekto ng Ateneo de Manila University upang turuan at hikayatin ang mga OFW sa iba’t ibang panig ng mundo na magnegosyo pagbalik nila sa Pilipinas.

“Nagsimula lahat sa 21 designs. Dahil sa tulong ng aming pamilya, unti-unting lumaki.  Nagdagdag sila ng pera,” ika niya. Mula t-shirt, nailapat ni Rex ang kanyang alam sa disenyo sa iba’t ibang bagay, gaya ng sign printing sa trapal na naging mabili noong eleksyon, paglagay ng karatula sa mga tindahan, pagdikit ng logo sa mga sasakyang pangnegosyo at maraming iba pa.

Madali sa kanya ang pagtanggap sa bagong responsibilidad, dahil maliit pa siya ay hinubog na siya ng ama. “Akay-akay po ako lagi ng tatay ko saan man siya mapunta. Siguro nasanay na at nahubog sa pangaral lagi ng aking tatay,” paliwanag niya.

Sa limang taon niyang paninilbihan bilang kapitana, naging mahaba ang listahan ng kanyang mga proyekto, na nagbigay sa Batuan ng iba’t ibang parangal, gaya ng Galing Pook Award na iginawad ng Provincial Liga ng mga Barangay. Ilan sa mga ito:

·        Streetlights project mula Purok 1 hanggang Purok 3: Nailawan ang 310 kabahayan.

·        Paghukay ng culvert sa Purok 1: Ang dalawang lugar na pondohan ng tubig ay hindi na bumabaha.

·        Sementadong kanal sa Purok 1 at 2 na may habang 45 meters at 110 meters  .

·        Pagsaayos ng irrigation system na dumidilig sa mahigit 100 hectare na palayan, na sinusuportahan ng Balasan LGU, Regional Kagawaran ng Agrikultura , Provincial Agriculture Office at Municipal Agriculture Office.

·        Pagpapaayos ng  barangay hall, na nabilhan ng dalawang air con, dalawang computer at printer, medical equipment at first aid kit, monoblock na upuan at  maraming pang iba na bigay ni  Iloilo Gov. Toto  Arthur Defensor Jr. at iba pang opisyal sa kapitolyo.

·        100 meters na concrete road na pinondohan ng DSWD, ni Mayor Filomeno Ganzon at Vice Mayor Toto Manuel Ganzon, at kinuhang trabahador ang mga naninirahan sa barangay.

·        Repainting ng buong plaza.

·        Communal Garden, kung saan ang inaaning gulay ay para sa mga batang mababa ang timbang.

·        Pagbibigay ng libreng gamit eskwelahan.

Malaki ang tulong ng komumidad sa Communal Garden.

Pero ang pagiging OFW niya sa Hong Kong ay nakatatak pa rin sa kanya, kahit 10 taon na siyang umuwi at nagkaanak na ng dalawa. Ka-chat pa rin niya ang panganay na alagang iniwan niya nang ito ay 12 taong gulang. Ito ay doktor na at iniimbita siya sa kasal nito. Ang ikalawa na mas bata ng limang taon, ay nasa college pa.

At ang payo niya sa mga OFW na nasa Hong Kong pa rin: “Huwag tayong mawalan ng pag asa. Mangarap tayo na makauwi at magtabi ng kita para makauwi sa ating pamilya, dahil ang tunay na kasiyahan ng ating puso at isipan ay makasama ang ating buong pamilya sa hirap man o ginhawa.”

Latest anti-illegal work raids net 17 arrests

Illegal work includes selling on the street by visitors, including those from the Mainland

 A total of 17 people were arrested over four days (Oct 30 to Nov 2) in a series of territory-wide crackdown on illegal work. They comprised 13 suspected illegal workers and four employers.

During raids carried out by immigration officers, 319 locations were raided, including commercial buildings, construction sites, massage parlours, premises under renovation and restaurants.

Twelve suspected illegal workers – three men and nine women aged 27 to 53 – were arrested. They included two women who hold recognizance forms as asylum seekers, which prohibit them from taking up work. Another woman is suspected of having used a forged HKID card in her possession.

Four suspected employers, two men and two women aged 35 to 56 were also arrested.

In  a separate operation, a female Mainland visitor aged 51 was arrested for breaching her condition of stay by engaging in suspected illegal parallel trading activities at San Wan Road in Sheung Shui. She was found peddling mainly cosmetic products and healthcare products.

Anyone found to violate their condition of stay, including tourists who take up illegal employment, are liable to be prosecuted and upon conviction, sentenced to up to two years in ail and fined a maximum of $50,000.

Illegal immigrants, overstayers or asylum seekers who engage in illegal work face a more severe penalty of up to three years imprisonment and a maximum fine of $50,000.

If the offender is found to have also used a forged HKID card or one that belongs to another person, the corresponding maximum penalty is $100,000 fine and 10 years' imprisonment.

Employers face the direst sentence of up to $500,000 in fine and imprisonment of up to 10 years.

A mere failure to check a job applicant’s HKID card or valid travel document and make further inquiries about the person is likewise deemed as an offence for which the prescribed sentence is a maximum fine of $150,000 and imprisonment for one year.
