$500 fine, suspended sentence for stealing slippers

Both theft cases were heard at Fanling Court before the 2nd was transferred to District Court

A Filipina domestic helper who admitted stealing two pairs of slippers on two different occasions from her employer has been fined $500 and sentenced to 10 days in jail, suspended for 18 months.

V.P. Reyes, 36 years, was meted the punishment on Oct. 24, Tuesday, at Fan Ling Magistracy after she pleaded guilty to one count of theft.

The fine she was ordered to pay and was taken from her bail was smaller than the $600 value of the slippers stolen from Tsang Tsz Kit on June 1 and Sept. 17 this year, at house no 10F, Kau Lung Hang Lo Wai, Tai Wo Service Road East, Tai Po.

However, the cost to Reyes was far heavier, as she was dismissed from her job and because of her criminal conviction, would likely be barred from working in Hong Kong again.

Meanwhile, another Filipina who is charged with stealing nearly $300,000 worth of cash and 86 pieces of jewelry valued at about $250,000 from her employer, appeared at the District Court for the first time, also on Tuesday.

Merlyn Q. Bugtaoen, 32, was initially charged at Fan Ling Magistracy with stealing 10 bracelets, 9 bangles, 20 pendants, 31 rings, 13 necklaces, one necklace with pendant, one watch and one pair of earrings.

She also allegedly stole cash in various denominations: $50,000 in HK dollars, 5,000 Thai Baht and $15,000 Taiwan dollar worth a total of $297,098, all belonging to Yiu Ching Heng.

The alleged thefts happened in Flat A, 1st floor, Mee Fat Building at 34-48 Tai Wing Lane, Tai Po sometime in March 2022 until March 26, 2023.

She was supposed to have taken her plea during the hearing at the District Court but at the request of the prosecution the case was adjourned to December 28 this year.

Bugtaoen was returned to jail until the next hearing of her case.

Court upholds rule requiring dog bites reported to police

The case against a Filipina and her employer whose dog had bitten someone, will push through after the court today rejected the argument of their lawyers that the charge filed against them violates their right against self-incrimination and to remain silent.

Aiza Tenorio, 34, and Stephanie Chong were issued a summons by the Eastern Court to appear on a charge of failing to report immediately to the nearest police station that a dog under their care had bitten a person last Nov. 30, 2022.

Such failure violates Section 24 of the Rabies Ordinance, which sets a penalty of $10,000 fine.

The complaint was filed by the Agriculture, Fisheries and Conservation Department last May 30.

Their lawyers, taking turns to argue their point in a hearing today at the Eastern Court, said such a requirement to report violates the Bill of Rights and the Basic Law of Hong Kong.

Self-reporting opens themselves to further prosecution, they argued.

Besides, since Hong Kong faces no threat of a rabies outbreak, such a requirement is unnecessary, they added.

But Deputy Magistrate Charles Kwok rejected the arguments, saying that a reading of the law shows that reporting a biting incident only requires information about the dog involved.

“There was no requirement to give particulars of the keeper of the animal,” he said, “just facts about the dog involved” such as whether the dog had been vaccinated against rabies and whether it had been implanted with microchip to establish its identity.

Therefore, he added, the rule does not impinge on the dog keepers’ right to silence or against incriminating themselves.

Magistrate Kwok thus adjourned the case for Nov. 16, during which the trial schedule will be set.

Hot on the heels of the alleged student visa scam to Canada perpetrated on a group of Filipino domestic workers in Hong Kong, another group of Filipino migrants has come forward, claiming to have been duped into paying hard-earned money for non-existent jobs in Norway.

Of the 24 complainants, five are working in Hong Kong and the rest, in Dubai, Arab Emirates, Kuwait or Saudi Arabia. They all have receipts showing they each paid around 7,000 AEB or HK16,000 to Dubai-based Insider Migration Services (IMS) FZCO, for a total of HK384,000 or Php2.76 million.

Most of the complainants said they saw a Facebook post by IMS sometime in August last year which said the company, which is operating on a trade license issued by Dubai, could send Filipino housekeepers to Norway.

One of the Hong Kong applicants, Ana, said she contacted the number indicated in the Facebook advertisement and sent her CV as instructed. The very next day, she received an email from an IMS "consultant,"  Kathlyn Marcos, stating that her documents had already been forwarded to Norway and that their associates would liaise with employers there to secure her a post as a housekeeping attendant.

To initiate the supposed job-matching, Ana paid the 7000 AEB fee through Western Union to the general manager of IMS, Khalid Walid Almafouhd Naser, on September 25 last year. Naser allegedly assured her she could expect to be deployed to Norway after four to six months.

For the next eight months however, Ana said she was never interviewed by any potential employers in Norway and worse, IMS staff stopped responding to her emails.

On May 26 this year she followed up her application with the company, and instead of apologizing for or explaining the delay to her, she was warned that legal action would be taken against anyone who smeared the company’s name on social media.

On May 31, Ana tried to ask for a refund as she reportedly discovered that the job order sent to her by IMS was illegal as it had been altered.  However she was told that this was not possible as her documents had already been sent to an employer. The “Processing Department” of IMS also denied that the email sent to her had been edited. She could back out, but would not get her money back.

The next month, Ana sought help from the Philippine Consulate in Hong Kong to try and get her money back from IMS and those who claimed to be its staff, particularly Naser and Marcos. She also asked for help in getting those responsible for swindling her punished in accordance with law.

Interviewed by The SUN, Ana said she and her fellow victims managed to hear of each other by chance. An email sent to them by IMS to celebrate an important Arab event was at the top of a thread where they were all asking about the jobs promised them in Norway.

She added all of them tried all avenues to get their complaints heard, but ended up facing a blank wall each time.

Those who are in Dubai have sought help from the police, but were told that what they were complaining about was a trade dispute, and not a criminal matter, so they had no jurisdiction.

Ana and all those outside of the Emirates also tried to file a claim online with Dubai authorities, but were told they needed to be residents there to be heard.

As a last resort, the complainants are looking at the Philippine government to help raise the matter with UAE authorities so they could get relief.

Asked about their plea, Assistant Labor Attache Antonio Villafuerte said the Migrant Workers Office has already endorsed their case to the Department of Migrant Workers in the Philippines, but said the victims in Dubai should also go to the MWO there to ask for help and get their claims authenticated.

At the very least, Villafuerte said the DMW should know about what happened to them so it can immediately send out a warning to prevent other Filipino workers falling into the same trap.

Norway has a small number of job openings for Filipinos, but they are mostly coursed through employment agencies registered with the Philippine Overseas Employment Agency, which is now under DMW.

To be safe, Philippine authorities always advise Filipinos to apply for overseas jobs from the country, instead of doing “cross country” migration, or from another overseas destination, to protect them from unscrupulous agents.

Despite the advice, many Filipinos abroad still prefer to go to a third destination without going back to the country first, so as to avoid the long wait and the crippling expenses that often go with securing a better job elsewhere.

But as these complainants and many others who are clamoring for help now because they had been tricked into paying huge sums for non-existent jobs or opportunities, taking more caution and doing more research can go a long way toward avoiding many months, even years, of heartache and burst hopes.

14 illegal workers get 15-20 months in jail

Immigration officers detain one of thoise arrested.

The Immigration Department (ImmD) today announced the jailing of 14 illegal workers as it reiterated its warning that it will prosecute those who take employment without proper documents and hose who employ them.

The 14 were arrested in two ImmD operations on Oct. 17 to 19 and convicted in separate hearings on Oct. 20 and 23 at the Shatin Magistrates' Courts.

The first to be jailed was an Indonesian female, aged 56, who was arrested on October 17 while working as a dishwasher in a restaurant in Kwun Tong during a joint operation conducted by the ImmD and the Hong Kong Police Force codenamed "Champion".

She was was sentenced to 20 months' imprisonment at the Shatin Magistrates' Courts on Oct. 20 after she pleaded guilty to taking employment after having overstayed, breaching her condition of stay and overstaying in Hong Kong.

The other 13 were among the 14 persons engaged in packaging work, who were arrested in a joint anti-illegal worker operation between ImmD and the Hong Kong Police Force on October 18 to 19 at the Tseung Kwan O industrial area and charged on Oct. 23.

Twelve of them were each sentenced to 15 months’ imprisonment after they pleaded guilty to taking employment after having overstayed their visa, of possessing a forged Hong Kong identity card and overstaying in Hong Kong.

The remaining one in the group was hospitalized and his case was adjourned.

Filipina linked to love scam jailed 8 months

A Filipina domestic helper was sent to jail for eight months after pleading guilty to money laundering of proceeds from a love scam, while her four co-defendants denied the charges, setting the stage for a four-day trial at the Eastern Court.

Magistrate Minnie Wat handed the sentence to Maila Samson, 50 years old, after setting aside her lawyer’s plea for a light sentence and giving her credit only for her guilty plea with a 1/3 discount on the usual punishment of 12 months in prison.

Samson was immediately ushered into the detention area to start her prison term.

The hearing, held on Friday Oct. 20, continued with the co-defendants -- Wong Siu-uen, Marife Dionson, Geraldine Tolentino and Ires Calinawagan – pleading not guilty, and the prosecutors’ discussing their plan to rely mostly on video-recorded interviews the four gave to police.

But Magistrate Wat had to hand the case over to Principal Magistrate Ivy Chui to schedule the trial.

In a separate hearing, Magistrate Chui set the trial for Jan 23-26 next year.

Samson was charged with dealing with property known or believed to represent proceeds of an indictable crime, which is punishable under the Organized Serious Crimes Ordinance.

Her Hang Seng Bank account was linkled to an online love scam in which a Hong Kong woman was swindled of several millions of Hong Kong dollars.

A total of HK$571,850 and US$4,501.61 – part of which was believed to have been proceeds of the love scam -- were deposited and withdrawn in her account between July 15, 2020 and Aug. 7, 2020. In HKD, the total amount was about $607,000.

During police investigation, Samson claimed that she had earlier lost the ATM card for this account along with her wallet and passport, but admitted she did not report the loss to the bank or applied for a new card, which could have prevented the misuse of her account.

The four co-defendants face similar charges. Wong was freed on $2,000 bail while the other Filipinos posted bail of $1,000 each.

Wong, 53, together with another person with a name written in Chinese, had the biggest amount deposited and withdrawn in her Hang Seng Bank account, at a total of $776,460 between June 15, 2020 and Aug. 20, 2020.

The HSBC account of Dionson, 43, saw the inflow and outflow of a total of $358,300 within two days --on July 8 and 9, 2020.

Tolentino, 38, together with a person named “Wai”, had her HSBC receive $566,438 in deposits that were withdrawn within five days, on July 15-20, 2020.

The HSBC account of Calinawagan, 49, was used as temporary depository for $714,406 on July 10 to 23, 2020.
