Pinoy DH ikinulong ng 2 buwan dahil sa ilegal na trabaho

Nahatulan ng pagkabilanggo ang isang Pinoy DH dahil sa ilegal na trabaho.

Isang Pilipino ang ipinakulong ng dalawang buwan kanina matapos umaming ilegal na nagtrabaho sa tindahan ng kanyang amo, samantalang  domestic helper ang visa niya.

Napaluha si R.C. Roberto nang ilayo ng mga pulis mula sa harap ng hukom sa Shatin Magistracy pagkatapos niyang masentensiyahan ng "breach of condition of stay," at dalhin sa isang kuwarto para hintayin ang paglipat sa kanya sa kulungan.

Kasabay niyang humarap sa kaparehong akusasyon ang isa pang domestic helper, si L. Ladrillo, na humingi ng palugit hanggang Mar 11 para harapin ang kanyang kaso, na sinang-ayunan naman ni Acting Principal Magistrate David Cheung Chi-way.

Ayon sa sakdal na binasa sa kanya at isinalin sa Tagalog ng interpreter,  hinuli si Roberto noong Mar. 6, 2021 nang mag-imbestiga ang mga pulis sa isang tindahan ng marine products ng kanyang amo sa Sai Ying Pun.

Nagpunta ang mga imbestigador sa umaga at hapon, at sa parehong pagkakataon, nakita siyang may suot na asul na t-shirt na may marka ng kumpanya at nagsisilbi sa mga parokyano.

Ayon sa isang testigo ng taga-usig, si Roberto ay nagtatrabaho sa lugar na ito mula ika-9 ng umaga hanggang ika-8 ng gabi.

Nang tanungin siya kung tinatanggap niya ang salaysay, sumagot si Roberto ng oo.

Humingi ng pang-unawa kay Magistrate Cheung ang abugado ni Roberto, na nagsabing may malinis na record ang akusado simula nang dumating ito sa Hong Kong noong November 2018.

Sinabi niya na ang employer ni Roberto ay may kapansanan, kaya kailangan na laging may naka-alalay hanggang sa lugar ng kanyang negosyo. Nagsabi rin ang amo na kukunin pa rin niya si Roberto kung papayagan itong magtrabahong muli sa Hong Kong.

Ayon din sa abugado, si Roberto ay tumutulong sa tindahan dahil napakiusapan lang ng mga empleyado nito.

Hindi siya binabayaran nang dagdag sa ginagawa sa tindahan ng amo. At sa sahod niyang $5,000, $3,500 ang ipinadadala niya sa pamilya sa Pilipinas.

Ayon kay Magistrate Cheung, isinaalang-alang niya ang malinis na rekord ni Roberto, ang kanyang pag-amin, at ang paliwanag kung bakit kailangan siyang kasama ng among may kapansanan kahit sa trabaho nito.

Ang nararapat na parusa kay Roberto aniya, ay tatlong buwang pagkabilanggo. Binigyan niya ito ng 1/3 na discount dahil sa pag-amin kaya naging dalawang buwan ang sentensiya.

Ayon sa Immigration Ordinance ng Hong Kong, ang parusa sa paglabag sa condition of stay ay multang hanggang $50,000 at pagkakakulong na hanggang dalawang taon. -- LD

Inamin ni Garcia ang kasalanan nang humarap sa Kwun Tong Court

Ano ang gagawin mo kung inis na inis ka na sa kapitbahay ng amo mo na laging nagpa-park ng kanyang kotse sa inyong daanan?

Ang ginawa ni M. V.  Garcia ang nagdala sa kanya sa Kwun Tong Magistracy sa demandang criminal damage, sa harap ni Principal Magistrate Bina Chainrai.

Ayon sa dokumentong binasa sa kanya at isinalin ng interpreter sa Ilocano, ginalusan ni Garcia ang kotse ng kapitbahay nila sa Sai Kung nang tatlong beses mula Agosto hanggang Oktubre ng 2021.

Ang sagot niya sa lahat ng paratang: Guilty.

Bago nagsabi ng kanyang hatol si Judge Chainrai, hiniling ng abogado ni Garcia na hindi ito ikulong ng dahil sa nagawa niya, lalo at agad naman niyang inamin.

Isa pa, kasama sa kanyang trabaho bilang domestic helper ang mag-alaga ng isang may Alzheimer's disease na kailangan siya araw-araw.

At, sa edad na 64, siya pa rin ang tumutustos sa ikinabubuhay ng kanyang pamilya sa Pilipinas -- dalawang anak, apat na apo at ang kanyang ina na 84 taong gulang.

Sumagot dito si Chainrai: "She should not support them, should she? (Hindi na niya dapat silang suportahan, hindi ba?)"

Maliban sa hindi pagsang-ayon sa napiling pamumuhay ni Garcia, hinatulan ni Chainrai ito ng multang $1,000, at $2,000 bilang kabayaran sa nasira niya.

Filipina jailed 4 months after admitting she stole Rolex watch

A Filipina was jailed four months today after she admitted at the West Kowloon Magistracy that she stole a Rolex watch from her employer’s friend.

Janice F. Balleser, 38, tearfully pleaded guilty after the charges were read to her by an interpreter. “Yes po,” she answered when the interpreter asked her in Filipino if she agreed with the facts read to her from the case document.

The case began when Balleser was sent on an errand by her employer to the latter’s friend in Cheung Sha Wan on July 11, 2021.

On July 20, her employer’s friend, who was identified as PW (Prosecution Witness) 1, noticed that his Rolex watch worth $50,300, was missing. He complained to police on Aug. 5.

Police investigators traced the watch to a pawnshop, where it was pawned for $10,000.

A pawnshop employee, who was identified as PW2, said the pawner had shown her Hong Kong ID and left her address. It turned out to be Balleser.

When Balleser was arrested on Oct. 5, police also found the pawnshop’s receipt in her wallet. She was then terminated by her employer.

The defense lawyer told Magistrate Amy Chan Wai-mun that Balleser understood that her crime required a prison term, but asked for a shorter sentence so she could go home to the Philippines earlier and rejoin her 16-year-old daughter.

The lawyer said she had a clean record, cooperated with police investigators and even gave them the pawnshop receipt that was later used as evidence against her.

The fact that she did not steal from her employer but from someone else indicates that it was not planned, and she was only overtaken by greed when she saw the watch on a table and stole it, her defense added.

Magistrate Chan noted that aside from its monetary value which Ballecer was unable to pay back, a Rolex also had a sentimental value to its owner.

She set an initial prison term of six months and gave a one-third discount, leaving four months for Ballecer to serve in jail.

Pinoy bartender fined $4k for criminal damage, assaulting officer

A magistrate at Eastern Court ordered Sy's arrest after he failed to appear at a hearing of his case 

A 20-year-old Filipino male bartender against whom an arrest warrant was issued for failing to appear in an earlier hearing, has been fined a total of $4,000 for criminal damage and assaulting a police officer.

S.P. Saracanlao admitted his offenses on Dec 6 before Eastern Magistrate Veronica Heung, a month after failing to appear in a previous hearing supposedly for his plea-taking. A warrant for his arrest was issued by Magistrate Bina Chainrai at the time.
After his plea, Heung asked Saracanlao why he absconded in the last hearing, and he said he had no money and that he had written the court explaining his absence.

Asked if he had a job and how much he was earning, Saracanlao said he was working parttime as a bartender earning a total of $4,000 a month. He said he was born here and was living with his father and grandmother.

Heung imposed a $2,000 fine for each charge, and offset $100 of the penalty from his bail money.

Saracanlao asked if he could have a month to pay the fine because he had no money, and the magistrate agreed.

The prosecution said Saracanlao, who was drunk, was arrested at dawn on May 18 after he punched and cracked the glass backdoor of California Tower in Central when accosted by a guard for entering the building with a friend and causing nuisance.
At the Central Police Station, he turned emotional while being interviewed and angrily pointed his index finger at officers Cheung King-on and Kwok Hoi-ming. He then poked Cheung’s left eye with his finger.

Cheung was sent to Queen Mary Hospital where he was treated for tenderness in the left eye and discharged.
