Three Indonesian women - two overstayers and one asylum seeker, were each sentenced at Shatin court on Monday to a total of 15 months imprisonment after pleading guilty to working illegally as dishwashers in a Chai Wan restaurant.
The women aged 34 to 41, were arrested during an
anti-illegal worker operation conducted by Immigration investigators on Feb.
18.
During an identity check one of the women produced a
recognisance form which does not allow her to take up any work. The two others
were found to have overstayed their visas.

The three were charged with taking employment while under
a removal order or had breached their limit of stay.
They all pleaded guilty to the charge and were each
sentenced to 15 months behind bars.
The two overstayers were given additional sentences
of between 12 to 15 months’ jail for breaching their visa conditions. But since
the sentences were ordered to run concurrently,, the net result was still 15
months in jail.

Immigration again warned that taking up illegal
work, whether paid or unpaid, could land one in jail for up to three years, and
fined a maximum of $50,000.
Those who use or possess a forged Hong Kong identity
card or one belonging to another person face more serious penalties of up to
$100,000 fine and 10 years’ imprisonment.
Employers of
illegal workers are liable upon conviction to a maximum
fine of $150,000 and to imprisonment for one year. To be held accountable, they are not just required to check a job applicant's HKID card but must take all practicable steps necessary to determine if the person is lawfully employable. That includes making enquiries about the person.

In relation to this, Immigration warned all employers
not to defy the law by employing illegal workers, and vowed to continue cracking
down on offenders.
