Filipino who ignored order to pay $5k fixed penalty told to pay double

A Filipino man who ignored an order to pay a $5k fixed penalty for an illegal gathering on the second floor of Fai Man Building on Li Yuen Street West in March last year was today, Jan. 28,  ordered to pay double the amount, plus costs.

J.P. Castro, 35, was told to pay a total fine of $10,000 plus $300 costs when he appeared in Eastern Magistracy today.

He was charged with taking part in an illegal gathering which happened on Mar 12, 2021. 

Under section 4(2) in part 2 of Schedule 2 of Cap.599G that was in force at the time, the gathering of more than four people in public or in scheduled premises was prohibited.

He was served notice dated May 4, 2021 to pay a $5,000 fixed penalty for the violation, but he failed to comply with the order, or served notice that he wished to dispute liability.

As a result, an order was issued in the name of the Secretary of Justice for Castro to pay, aside from the fixed penalty, an additional penalty equal to the amount of the fixed penalty, and costs.

On Oct 5, 2021 the court ordered Castro to pay a total of $10,300 within 14 days, or face arrest.

As he again failed to comply with the order, Castro was ordered arrested, but was subsequently allowed to post bail.

During today’s proceedings when he finally appeared, the $10,300 was ordered deducted from his bail money, with the balance being returned to him.
