US imposes travel restriction on HK as Covid tally shoots to 29k

From Jan 5, all passengers flying to the US from HK should show a negative test result for Covid

Hong Kong reported 29,207 new Covid-19 infections Saturday, including 424 imported cases. 

Another 52 related deaths have been reported.

There are now 5,151 Covid patients in public hospitals and among them, 197 are listed in critical condition and 191 are seriously ill.

The new surge in cases came as the United States imposed Covid-19 testing for all arrivals from China, including Hong Kong and Macau.

From January 5, all arrivals aged five and above from the three places will have to show a negative Covid-19 test result before being allowed to board their flights.

The test should have been carried out no more than two days before the passengers’ departure, the US Centers for Disease Control and Prevention announced on Wednesday.

Arrivals can either undergo a PCR test, or a rapid antigen test administered and monitored by a telehealth service or a licensed provider, for which a written proof is needed.

The US joined Japan, Italy, Malaysia and India in imposing restrictions on arrivals from China. Even the Philippines has hinted it may require negative testing for all arrivals from China, but said whatever decision is made will be based on science.

However, the US is the only country so far to specifically include Hong Kong and Macau in the entry restrictions.

The decision to single out China for the mandatory pre-boarding tests was made after the world’s most populous country eased its pandemic restrictions, leading to a surge in coronavirus infections.

Media reports say China is experiencing an unprecedented Covid-19 outbreak, overwhelming hospitals and crematoriums. But no official data has been made available after health officials stopped releasing an official daily Covid death toll last week.

14 people arrested in anti-illegal worker operations

Six women suspected of working illegally were among those arrested in the latest raids

Immigration officers have arrested 14 more people in a series of territory-wide anti illegal-work operations for two consecutive days, from December 28 to 29.

Those arrested during operations codenamed “Twilight”  and “Champion” were 10 suspected illegal workers, three employers and one overstayer.

During the “Twilight” operation, officers raided five target locations such as a commercial building, premises under renovation, and restaurants - and arrested seven suspected illegal workers and two employers.

Among them was a woman holding a recognizance form, which prohibits her from taking any employment. The other person arrested was a man suspected of possessing and using a forged Hong Kong identity card.

Those suspected of doing illegal work comprised one man and six women, aged 30 to 47. The two employers, a man aged 34 and a woman aged 56 were also arrested.

In the “Champion” operation, officers raided 93 locations in Eastern district, including premises under renovation and residential buildings.

Arrested were three suspected illegal workers, one employer and one overstayer. The workers were all men, aged 26 to 48, and all were holders of recognisance forms.

Also arrested was a 35-year-old man suspected of employing the illegal workers, as well as a female overstayer aged 40.

Immigration warned that anyone who contravenes a condition of stay, such as working illegally, could be prosecuted and if found guilty, face a maximum fine of $50,000 and up to two years’ imprisonment. Aiders and abettors are also liable to prosecution.

Those found in possession of someone else’s HK ID card face a maximum fine of $100,000 and up to 10 years’ imprisonment.

People who hire illegal workers face the heaviest penalty of $500,000 fine and imprisonment for up to 10 years.

In-person classes to resume in Feb as Covid cases nearly hit 28k

Schools in all levels will reopen starting on Feb 1

Health authorities on Friday reported 27,830 new Covid infections, of which 946 were imported.

Another 72 patients with Covid have died.

The bulk of the local cases, or 22,045, were detected by rapid antigen tests while the remaining 4,839 cases were positive results from PCR tests.

Authorities said they are continuing their epidemiological investigation into the infected cases.

Hong Kong has so far recorded nearly 2.6 million cases of Covid so far.

The new surge in cases happened as the government gave more details of the easing of pandemic restrictions, including the gradual resumption of classes starting in February next year.

According to a press statement, the Education Development Board has decided that, regardless of student vaccination rates, all secondary schools (including secondary sections of special schools) will resume whole-day face-to-face classes from February 1 while primary schools (including primary sections of special schools) and kindergartens will resume from February 15.

However, the negative RAT test result currently required of students and staff will continue until January 31 at the earliest.

As the Vaccine Pass scheme has been lifted starting on December 29, anybody entering school premises will no longer be asked to produce their vaccination record.

HK lists 13 statutory holidays for 2023

If the holiday falls on a Sunday or a worker's rest day, a holiday should be given the next day

 The 13 statutory holidays for 2023 are:

1. The first day of January – January 1

2. The second day of Lunar New Year – January 23 

3. The third day of Lunar New Year – January 24 

4. The fourth day of Lunar New Year – January 25

5. Ching Ming Festival -  April 5

6. Labour Day – May 1

7. The Birthday of the Buddha – May 26 (added since 2022)

8. Tuen Ng Festival – June 22

9. Hong Kong Special Administrative Region Establishment Day – July 1

10. The day following the Chinese Mid-Autumn Festival – September 30

11. National Day – October 1

12. Chung Yeung Festival – October 23

13. Chinese Winter Solstice Festival or Christmas Day (at the option of the employer)- December 22 or December 25

Please note:

(i) According to the Employment Ordinance, when either Lunar New Year's Day, the second day of the Lunar New Year or the third day of the Lunar New Year falls on a Sunday, the fourth day of the Lunar New Year is designated as a statutory holiday in substitution. As the first day of Lunar New Year of 2023 falls on a Sunday, the fourth day of Lunar New Year will be designated as a statutory holiday 

(ii) In the event that the day following the Chinese Mid-Autumn Festival falls on a Sunday, the day thereafter is designated as a statutory holiday in substitution.

(iii) All employees are entitled to the above statutory holidays. If the statutory holiday falls on a rest day, a holiday should be granted on the day following the rest day which is not a statutory holiday or an alternative holiday or a substituted holiday or a rest day.  An employee having been employed under a continuous contract for not less than 3 months is entitled to the holiday pay which is equivalent to the daily average wages earned by the employee in the 12-month period preceding the holiday.

An employee is granted rest days on Sundays. As the National Day (1 October) falls on Sunday, the employer should grant a holiday on the next day (i.e. 2 October), but this day should not be a statutory holiday or an alternative holiday or a substituted holiday or a rest day.
